Welcome to Kids Shelf! These Terms of Service ("Terms") govern your use of the Kids Shelf mobile application ("App") and related services. By downloading, installing, or using Kids Shelf, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Kids Shelf, you confirm that:

• You are at least 18 years old, or you are using the app with parental/guardian consent
• If you are a parent or guardian, you consent to your child's use of the app
• You agree to be bound by these Terms and our Privacy Policy

2. Description of Service

Kids Shelf is an educational mobile application, with a companion website, designed to help children learn through:

• Math and science lessons for Kindergarten to Grade 8, with narration, pictures and quizzes
• Interactive storybooks with speech recognition
• Real-time feedback on reading accuracy
• Speech pattern analysis and practice exercises
• Progress tracking and gamification features
• Vocabulary building tools and word games
• A Learning Record that summarizes time learned and lessons completed for parents

3. User Accounts and Profiles

Optional Parent Account

Kids Shelf offers an optional parent account for adults. The app works without one. Account creation requires an email address, a name and a password. You may delete your account at any time from Settings > Parent Account > Delete Account, or by following the steps at kidsshelf.app/delete-account; this permanently removes your account data from our server. See our Privacy Policy for details.

Child Profiles

You may create profiles for your children within the app. These profiles:

• Are stored only on your device
• Are not transmitted to our servers, even with a parent account
• Can be deleted at any time through the app settings
• Will be permanently deleted if you uninstall the app

4. Permitted Use

You may use Kids Shelf for:

• Personal, non-commercial educational purposes
• Helping children learn to read and learn math and science, including as part of homeschooling
• Tracking reading progress for your children
• Educational use in home or classroom settings

5. Prohibited Use

You may NOT:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works from the App
• Distribute, license, or sell the App or any part thereof
• Use the App in any way that violates applicable laws
• Attempt to circumvent any security features
• Use the App to collect data about other users
• Use the App for any commercial purpose without authorization

6. Content and Intellectual Property

App Content

The Kids Shelf application, including its design, code, graphics, and original content, is owned by Kids Shelf and protected by intellectual property laws.

Stories and Lessons

Stories and lessons available in the App may include:

• Original Content: Stories created by or for Kids Shelf
• Public Domain Content: Classic stories from sources like Project Gutenberg
• Licensed Content: Stories used with permission from rights holders

Many stories and lessons, including their text, pictures and narration, are created with the help of AI tools and checked before they are published. Despite that care, a lesson may contain a mistake. If you find one, please tell us at [email protected] and we will fix it.

User-Generated Content

Any data you create within the App (profiles, progress data, bookmarks) remains on your device and is not transmitted to us. The only usage information we receive is anonymous lesson feedback (such as quiz answers and lesson ratings), which does not identify a child or family, as described in our Privacy Policy.

7. Subscriptions, Free Trials and Codes

Kids Shelf is free to download. Some features, such as complete courses, may require a paid subscription ("Premium"). If you buy one:

• Who you pay: purchases in the app are made through your Apple App Store or Google Play account and are subject to their terms. Purchases on our website are processed by Stripe.
• Automatic renewal: a subscription renews automatically at the end of each period (monthly or yearly) at the price shown when you bought it, unless you cancel at least 24 hours before the period ends. Your account is charged within 24 hours before renewal.
• Free trials: if a free trial is offered, it turns into a paid subscription when it ends unless you cancel before then. One free trial per account.
• Cancelling: manage or cancel in your App Store or Google Play account settings, or, for website purchases, from the link in your receipt or by emailing us. Cancelling stops future renewals; you keep access until the end of the period you paid for.
• Refunds: refunds for App Store and Google Play purchases are handled by Apple and Google under their policies. For website purchases, contact us within 14 days.
• Price changes: we will tell you before a price change applies to your subscription, as the stores require.
• Family: one subscription covers all the child profiles in a family, on the devices where the parent signs in or restores purchases.

Gift and promo codes. Codes we give out may unlock Premium for a set time or give a discount. A code can be used once per family unless it says otherwise, has no cash value, cannot be sold or exchanged, and may expire. We may cancel codes that were obtained or shared improperly. Free access from a code ends at the end of its period unless you subscribe.

Purchases are for parents and guardians. The app puts purchases behind a parent check.

8. Speech Recognition Technology

On-Device Processing

Kids Shelf uses proprietary on-device speech recognition technology. By using the speech recognition features, you acknowledge that:

• Audio is processed in real-time on your device
• Audio is never recorded or stored
• Audio is never transmitted to any server
• The speech model file is downloaded once; after that, speech recognition works without an internet connection
• Speech recognition accuracy may vary based on device capabilities, background noise, and speech clarity

9. Educational Disclaimer

Kids Shelf is designed as a supplementary educational tool. You acknowledge that:

• The App is not a substitute for professional reading instruction, tutoring, or special education services
• Speech pattern analysis is for informational purposes and is not a medical or professional diagnosis
• If you have concerns about your child's reading or speech development, consult qualified professionals
• Progress tracking reflects in-app performance and may not correlate directly to standardized assessments

10. Disclaimer of Warranties

KIDSHELF IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy of speech recognition
• Warranties regarding educational outcomes

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIDSHELF AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Any loss of data, profits, or goodwill
• Any damages arising from your use or inability to use the App
• Any damages related to educational outcomes or reading development

Our total liability shall not exceed the amount you paid for the App (if any) in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Kids Shelf, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

13. Children's Safety

Kids Shelf is designed for children and includes the following safety measures:

• No social features or communication with strangers
• No user-generated content sharing
• No advertising, and purchases only through a parent check
• No collection of personal information
• Parent/guardian controls for app settings

14. Updates and Changes

App Updates

We may release updates to improve functionality, fix bugs, or add features. Some updates may be required for continued use of certain features.

Terms Updates

We may modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms.

15. Termination

You may stop using Kids Shelf at any time by uninstalling the App. We reserve the right to terminate or suspend access to the App for violations of these Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kids Shelf operates, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Good faith negotiation between the parties
2. If negotiation fails, binding arbitration in accordance with applicable arbitration rules

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kids Shelf regarding your use of the App.
